Acceptance of Terms
By accessing or using Puff Deli (the “App”) and the Puff Deli website at https://www.puffdeli.com (the “Site”), you agree to be bound by these Terms of Service (the “Terms”) and Puff Deli’s Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App or Site.
About Puff Deli and the Services
Puff Deli provides a platform that lets users import media and web links into weekly schedules, create and share public libraries called “Delis,” follow or copy Delis created by others, and use an AI-powered coach and premium subscription with extended usage limits.
The App and Site may include features that are added, removed, or modified from time to time without notice.
Changes to Terms
We may modify these Terms from time to time. We will post updated Terms on the Site and within the App and indicate the effective date. Your continued use after the changes are posted constitutes your acceptance of the revised Terms.
Accounts and Security
You may need to create an account to access certain features. You must provide accurate, current information and keep your account credentials secure.
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login information. Notify Puff Deli promptly of any unauthorized use or security breach.
Content, Licenses, and Delis
Your Content: You retain ownership of content you upload to Puff Deli. By uploading content, you grant Puff Deli a worldwide, non-exclusive, royalty-free license to use, reproduce, display, modify, adapt, publish, and distribute your Content as necessary to operate the App and provide the services (including for backups and improvements). This license ends when you delete the Content or terminate your account, subject to retention for legal obligations.
Delis: Delis can be public or private. Public Delis are accessible to other users and may be followed or copied. When you copy a public Deli, a new resource is created in your account and you will have access to that copied content as part of your Delis.
Intellectual Property: Puff Deli owns the App and its content other than Content you provide. You grant Puff Deli rights as described above to operate and improve the Service. You retain ownership of your Content unless you grant Puff Deli the licenses described herein.
Prohibited Content and Conduct: Do not upload content that infringes others’ rights, is illegal, obscene, or harmful; do not use the Service to violate laws or infringe third-party rights. Puff Deli may remove content or suspend/terminate accounts for violations.
DMCA and Takedown: If you believe your content has been wrongly posted or want it removed, follow Puff Deli’s notice and takedown process described in the Privacy Policy or support channels.
Subscriptions and Payments
Puff Deli Premium: Access to extended usage limits and additional features is available via a paid premium subscription.
Billing: Payments are processed by third-party payment processors. Puff Deli does not handle full payment card data directly.
Auto-Renewal and Cancellations: Premium subscriptions may auto-renew unless cancelled. You can cancel through the app or site; cancellation takes effect at the end of the current billing period.
Changes and Refunds: Prices and plan features may change. Refund eligibility and policies are governed by the payment processor and applicable law; contact us if you believe you have a refund entitlement.
Taxes: You are responsible for any taxes associated with your purchase.
AI Coach
The AI-powered coach provides general fitness and personal development guidance based on your data and Delis. It is not medical, legal, or professional advice. Use your own judgment and consult professionals as needed.
Data use: We may use data you provide (and data generated by your interactions with the App) to train or improve AI models, unless you opt out where such an opt-out is provided.
Control: You may adjust preferences to limit or disable AI features where available.
Third-Party Services
Puff Deli may rely on third-party services for hosting, analytics, payment processing, AI services, and other functionalities. These third parties may have access to your information as needed to perform their functions and are bound by their own privacy policies.
Privacy
Your use of Puff Deli is subject to Puff Deli’s Privacy Policy. The policy explains what data we collect, how we use it, and with whom it is shared. Please review it at https://www.puffdeli.com/privacy (or as otherwise provided in-app).
Prohibited Conduct
You agree not to misuse the App, interfere with or disrupt the integrity or performance of Puff Deli, attempt to gain unauthorized access to Puff Deli’s systems, or facilitate the dissemination of malware or illegal content. You may not attempt to bypass security or usage limits, or engage in activities that would damage Puff Deli or other users.
Intellectual Property
Puff Deli owns or licenses all rights in the App and its content (excluding user-provided Content, which remains with the user). You agree not to copy, reproduce, distribute, create derivative works, or otherwise exploit Puff Deli’s intellectual property outside the scope of the App’s features without Puff Deli’s express written permission.
Disclaimers and Limitation of Liability
The App and Site are provided “as is” and “as available.” Puff Deli disclaims all warranties of any kind, whether express or implied.
To the maximum extent permitted by law, Puff Deli and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or goodwill, arising out of or in connection with the use of or inability to use the App.
Puff Deli’s total liability for any claim arising out of or relating to the App shall not exceed the amount paid by you to Puff Deli in the twelve months preceding the claim, if any.
Some jurisdictions do not allow certain limitations on implied warranties or liability, so these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Puff Deli and its affiliates, and their directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the App, your Content, Delis, or your violation of these Terms.
Termination
Puff Deli may suspend or terminate your access to the App and Site for violations of these Terms or for safety reasons, with or without notice. Upon termination, your right to access or use the App ceases, and Puff Deli may delete or retain your Content in accordance with its data retention policies and applicable law.
Termination does not relieve you of unpaid obligations or liabilities incurred before termination.
Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Puff Deli operates or is incorporated. Any disputes arising under or relating to these Terms shall be resolved by binding arbitration in a mutually agreed location, under the rules of a recognized arbitration body, except that Puff Deli may seek provisional or injunctive relief in any court of competent jurisdiction.
Class action waiver: To the maximum extent allowed by law, disputes will be resolved on an individual basis and not as a class action.
Notwithstanding the foregoing, you may bring claims in small claims court if your claims qualify.
Changes to Term and Suspension of Services
Puff Deli may modify or discontinue the App (or any portion) at any time with or without notice. Puff Deli will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App.
Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. No waiver of any term will be deemed a further or continuing waiver of that term or any other term.
Entire Agreement
These Terms, together with the Puff Deli Privacy Policy and any applicable plan agreements, constitute the entire agreement between you and Puff Deli regarding the App and Site and supersede any prior agreements.
Assignment
You may not assign or transfer your rights or obligations under these Terms without Puff Deli’s prior written consent. Puff Deli may assign its rights and obligations to a successor or affiliate.
Export Controls
You agree to comply with all applicable export and import laws and restrictions.

Miscellaneous
If Puff Deli merges, acquires, or transfers substantially all of its assets, your rights under these Terms may be transferred to the successor entity.
